REGULATION NO.23 OF 2010 CONCERNING IMPLEMENTATION OF NEW MINING LAW, PROVIDES MORE CLARITY ON OBTAINING A IUP
COALspot.com: Indonesian government has recently issued another regulation related to Law number 4 of 2009 concerning mineral and coal mining. Two regulations issued recently to support implementation of law no 04/2009. Regulation number 23 of 2010 concerning implementation of mineral and coal mining business activities issued on 1 February 2010, provides more clarity on the application process and obtaining a new Mining Business Permit (IUP).
An applicant who wishes to obtain an Mining Business Permit (IUP) must first obtain Mining Permit Area (WIUP) and then submit an application for the Mining Business Permit (IUP). A company or individual obtaining the right to a WIUP can apply for an Exploration Mining Permits (IUP Eksplorasi) and then a Production Operation Mining Permits (IUP Operasi Produksi).
Foreign based companies cannot apply WIUP directly. However 100% foreigner owned company, but registered in Indonesia under Indonesian law, can apply for WIUP and then for IUP. One company can hold only one Mining Permit Area (WIUP), except for listed companies, who may hold multiple WIUPs and IUPs.

The tender or application process is made to the relevant authority. Applicant must submit application to Regent of the Regency, if the Mining Permit Area (WIUP) is within one Regency, but with-in two Regencies, then to the Governor of the Province and within two provinces, then to the Minister.
Applicants are required to deposit a perseverance guarantee in cash with a state bank prior to submit the application and documents for WIUP. Applicants who pass the pre-qualification requirements are given access to the Government's research and survey data and may be given the opportunity for site visits.
A period of the bid award process shall not exceed 35 working days from date of submission of the bid / offer by applicant. Once a WIUP has been obtained, the winner of WIUP, must submit the application for the Exploration Mining Permits (IUP Eksplorasi) within 5 working days of date of announcement of the winner. If the applicant failed to submit IUP Eksplorasi application within 5 working days, then the applicant deemed to have withdrawn from the tender process and perseverance guarantee which submitted during WIUP tender process shall become the property of the Government.
Exploration Mining Permits (IUP Eksplorasi ) shall be granted for holders of WIUP and met other eligibility requirements. Exploration Mining Permits shall include the activities of general survey, exploration, and feasibility study.
Extensions to Production Operation Mining Permits (IUPs) must be submitted at least 6 months prior to the expiration of the IUP. Only two extensions are allowed and the WIUP must be surrendered back to government at the end of the second extension of the IUP.
Production Operation Mining Permit holders do not allow to haul, sale and / or processing of coal. The activities of hauling and sale and/or processing may be performed by third party that hold a specific purpose Production Operation Mining Permit for hauling and sale.
Coal trading companies must obtain specific purpose Production Operation IUP for hauling and sale of coal and Coal transporting companies must obtain specific purpose Production Operation IUP for hauling of coal and sale.
The specific purpose Production Operation IUPs can apply directly to relevant authority and no need to follow tender process.
IUP holders who export coal are required to refer to the benchmark price set by the Minister. Benchmark prices shall be determined by market mechanisms and/or refer prevailing on the international markets prices. The Minister for Energy and Mineral Resources already have issued a Ministerial Regulation on the prioritizing of coal supply for domestic needs on 31 December 2009.
IUP holders who are intent to appoint expatriates, require to submit an application to the Minister to obtain approval prior to employing expatriates.
Some more government regulations as well as ministerial regulations are expected to issue coming weeks to fully support of implementation of law no 04/2009.(cs)
