INDONESIAN GOVERNMENT IMPOSED ON NEW PROGRESSIVE ROYALTIES FOR COAL
Indonesian President Joko Widodo has signed a Government Regulation (Number 26 of 2022) on 15 August 2022 related to the progressive royalty rates for coal exports, and the regulation will come into effect on 15 September 2022.
According to the regulation, the progressive royalty rate applies based on Indonesian reference coal price (HBA) not on actual selling price. The highest royalty is fixed at 13.5%. The coal with calorific value of 5,200 kcal/kg on GAR basis and above, and the Indonesian reference coal price is above US$ 90 per tonne, the 13.5% of progressive royalty will be set. In August Indonesian reference coal price 2022 set at US$ 321.59 per ton basis 6322 kcal/kg GAR coal.
In the new regulation, the royalty rate is progressive which adjusts to the Reference Coal Price. The details are as follows:
Calorie Level 4,200 Kcal/kg on GAR basis and below
- HBA below US$ 70 per ton: Royalty 5%
- HBA US$ 70 – 90 per ton: Royalty 6%
- HBA US$ 90 and above per ton: Royalty 8%
Calorie Level 4,200-5,200 Kcal/kg on GAR Basis
- HBA below US$ 70 per ton: Royalty 7%
- HBA US$ 70 - 90 per ton: Royalty 8.5%
- HBA US$ 90 and above per ton: Royalty 10.5%
Calorie Level 5,200 Kcal/kg on GAR basis and above
- HBA below US$ 70 per ton: Royalty 9.5%
- HBA US$ 70 - 90 per ton: Royalty 11.5%
- HBA US$ 90 and above per ton: Royalty 13.5%
According to the previous regulation, PP 81/2019, the followings are the royalty set for coal:
- Calorie Level 4,700 Kcal/kg on GAR basis and below: 3% of selling price
- Calorie Level 4,700-5,700 Kcal/kg on GAR basis: 5% of selling price
- Calorie Level 5,700 and above on GAR basis: 7% of selling price
