GOVERMENT TO WITHDRAW CNC STATUS OVER SUSPECTED FLAWS - THE JAKARTA POST
The Energy and Mineral Resources Ministry’s directorate general for mineral and coal plans to review the clean and clear (CnC) status held by mining firms to ensure that requirements have been fulfilled, the Jakarta Post reported.
The JP further reported that, under the CnC policy, the holders of mining permits (IUP) in the country are required to ensure that their activities are in line with the government’s environmental policies, free from overlapping land rights and comply with tax and non-tax financial obligations. There are currently 10,776 IUPs for mineral and coal mining in the country. However, only 5,969 IUPs have been granted CnC status.
The mineral and coal directorate general secretary, Paul Lubis, said the office had found that numerous IUPs should not have been be granted CnC status.
“We admit that previous evaluations were not as detailed as now. We will improve and revoke the CnC status of the IUPS that have not fulfilled the necessary requirements,” Paul said on Friday, as quoated by JP.
He added that unresolved concession overlapping and the failure to meet several permits were grounds for the revocation of CnC status.
“For companies already holding an export recommendation, the revocation of CnC status will also impact the recommendation,” Paul said. A CnC status is also required if a company wants to obtain an export permit for their mineral products or coal.
The JP furhter said, the government implemented a ban on the export of mineral ore on Jan. 12 as part of the implementation of the 2009 Mining Law, which regulates obligations for domestic mineral processing and refining. Companies are only allowed to export semi-finished mineral products if they passed the minimum purification letter, already obtained CnC status and committed to building smelters.
As of October, the government also requires coal miners to obtain an export license before selling products overseas. The move is aimed at preventing excessive coal exploitation as well as establishing better coal-trade reporting.
National coal production hit 346 million tons during the January to October period, according to the director for coal, Bambang Tjahjono. Out of the amount, only as much as 82 million tons were sold to the domestic market while the remaining 264 million tons were sent abroad.
The government is trying to cap coal production at a maximum 421 million tons this year to ensure the country will still have enough resources for local power plants in the future.
Paul also said that the thorough assessment of CnC status would also be carried out because the mineral and coal office suspected attempts to seek loopholes to secure the status at the local-administration level.
‘This is likely due to the transfer of authority from a regency administration to provincial administration. We will be careful and perform joint monitoring with the KPK [Corruption Eradication Commission],” Paul said.
Under the new Provincial Administration Law, regency and municipal administrations will no longer have the authority to issue mining permits following allegations that high-ranking officials in local administrations often issued permits to certain firms for personal gain.
Following the implementation of the law, the control of the mineral and coal business will be in the hands of the central and provincial governments.
The CnC policy, which also requires the settlement of financial obligations, has contributed to higher payments to the state, according to director general for mineral and coal R. Sukhyar.
“As of Nov. 28 , payment from the sector has reached Rp 30.5 trillion (US$2.48 billion), which is Rp 2 trillion higher than the total income in 2013. This is despite lower coal prices and no exports of mineral ores,” Sukhyar said.
Under this year’s state budget, non-tax state income from the mineral and coal sector is targeted at Rp 39.67 trillion.
