PRESS RELEASE - CZECH COAL CONTESTS THE J&T AND IPO MERGER
 Prague, 3 August 2009 - The Czech Coal Group filed today objections to the proposed merger of the J&T Group and International Power Opatovice (IPO) with Úøad na ochranu hospodáøské soutìe (ÚOHS, Office for the Protection of Competition). Since also the ÈEZ and Dalkia groups are participating in the acquisition of control over IPO in addition to J&T, the European Commission is competent to assess this merger by the European legislation’s turnover criteria rather than ÚOHS.
“It is no longer possible to ignore the tide of oligopoly power sweeping over the Czech energy market, which, moreover, is backed by the State as the majority owner of dominant ÈEZ,” says Petr Pudil, Czech Coal a.s. Chairman and CEO. “The above groups’ jointly taken steps are capable of deepening the imbalance on the market of electrical energy generation and on the brown coal market even further,” explains Petr Pudil. According to Czech Coal’s analysis, the merger poses threat to competition on the relevant markets and also to the consumers’ interests on the domestic as well as European scale.
The Czech Coal Group includes Czech Coal a.s., a trader in energy commodities, mainly brown coal, electrical energy and greenhouse gas emissions allowances, and Litvínovská uhelná a.s., which holds the largest volume of coal reserves in the Czech Republic, Vršanská uhelná a.s., whose coal reserves within the mining limits will last until 2058, Czech Coal Services, a.s., which provides shared service to the extraction companies, and a number of other service companies. REN Power CZ, a.s., a leading Czech investor in renewable energy sources, was included into the Group this year.
