MORE COAL MINERS AGREE TO AMEND CONTRACTS - THE JAKARTA POST
The Energy and Mineral Resources Ministry is in a rush to beat a deadline for the conclusion of numerous memorandums of understanding (MoUs) with the country’s coal-mining companies before the change of government next month, the Jakarta Post reported today.
With the signing of the MoUs, the mining companies agree in principle to adjust their operating permits as well as their financial obligations, such as royalties, in line with the 2009 Mining Law.
According to post, in the last few days, a number of MoUs have been signed by the ministry’s director general for minerals and coal and the holders of coal contracts of work (CCoWs). “To date, we have signed 58 MoUs,” director for coal Bambang Tjahjono said on Thursday. The total number is a significant increase compared on the 44 CCoWs as of Sept. 5.
The MoUs will be the basis of the drafting of CCoW amendments, which are expected to be completed within six months after the MoU signing. The 58 CCoW MoUs signed already include deals with big coal players, such as PT Adaro Indonesia, PT Kaltim Prima Coal and PT Arutmin Indonesia, the paper reported.
The minerals and coal office is now working to accelerate the negotiation process with the other 15 CCoW holders.
Only PT Berau Coal and PT Kideco Jaya Agung remain among the big coal players holding the first generation CCoW holders which have not yet signed MoUs with the mineral and coal office, according to director general R. Sukhyar.
Paper's report says, as for Kideco, according to Sukhyar, the negotiating parties are still working to settle a disagreement on the amount of tax on dividends, in which the government wants to raise the figure to 20 percent, as stated in a regulation, from the current 10 percent as stated in the company’s CCoW.
The paper further said, meanwhile, discussions with Berau are in deadlock as the government wants to get a full royalty of 13.5 percent. “Currently, if Berau sells coal from the government’s share, it only pays 11 percent in royalties as the other 2.5 percent is calculated as transportation costs. We are now trying to make the payment a full 13.5 percent,” Sukhyar said.
The government is struggling to renegotiate a total of 107 contracts, consisting of 73 CCoW and 73 mineral contracts of work (CoWs), to be adjusted in line with the requirements of the 2009 Mining Law, the post noted.
Under the current target, the deadline for completion of MoUs is the end of September.
