NEW GOV'T REGULATION SHOULD INCORPORATE CONFLICT SETTLEMENT BODY - ICMA (MAJALAH TAMBANG)
A draft government regulation on mineral and coal is currently in a process of completion. The Indonesian Coal Mining Association (ICMA) proposed that a new body for conflict settlement be incorporated in the draft regulation. The new body would then be dependable for conflicts related to mining zones. ICMA further suggested that the regulation also endorses Initial Public Offerings (IPO) as a divestment model of foreign owned shares in Indonesia.
Supriatna Suhala, ICMA's Executive Director, revealed that the association had received four draft regulations on mineral and coal from the government, who is looking for inputs prior to the regulations' enactment. The four drafts would engage in several keypoints and activities in the new mining law: on mining zones, mining business, direction and supervision of mining, and on reclamation and post-mining.
In his assessment, the four draft regulations are still inadequate. On the issue of mining zones, for instance, there is no single mentioning of a conflict settlement body. To determine zonal areas for mining, the potential of a conflict is huge, therefore a special refereeing body is seen as a way to avoid frictions on the issue, said the spiritful Mr. Suhala. "In such a conflict, the body could ultimately decide on which sector to be given the opportunity to make use of the mining zone(s) first. In short, the body would be able to put the national interests above others," he added. In the past, the issue of overlapping of mining areas had among others pitted the mining sector against the forestry, the agricultural, and the environmental sectors.
Mr. Suhala also noted that a divestment obligation which should begin five years after the initial operation of a company here would only add to the corporation's woes. By then, companies would still be in debts to their financiers as their business are also still years away from their break even points.
On the discussion of mining business, Mr. Suhala stated that IPO is already a very transparent practice as a divestment model. "It should be conducted in the most transparent manner possible, otherwise it would not benefit (the sector)," he said.
Mr. Suhala then confirmed that ICMA would present all its views and suggestions during the next discussion on the draft regulations with the government and other stakeholders in the mining sector. The association has absolutely high hopes that when enacted, the bylaws would provide a certain support to create a more conducive investment climate in the mining sector.
